Rob Finkelstein has litigated a broad range of matters in federal and state courts and before various arbitral and administrative tribunals. He has represented clients in such matters as a multi-million dollar breach of contract claim relating to the theft of intellectual property, the valuation of a close corporation in a buy-out proceeding, dissolution of not-for-profit corporations, a fraudulent concealment case concerning real estate investments against an international brokerage firm, civil rights claims arising from a false arrest in the context of a mass arrest, class-action claims concerning allegations of market-timing, various regulatory investigations, and numerous contract and employment-related disputes.
Mr. Finkelstein has substantial experience in the area of administrative law, having successfully represented health care clients in proceedings before New York’s Department of Health and Board of Pharmacy as well as in connection with Medicaid provider audits and investigations conducted by the New York Office of the Medicaid Inspector General (“OMIG”), and in hearings and Article 78 proceedings, and appeals brought against OMIG.
Also active in the area of trusts and estates, Mr. Finkelstein’s experience includes probating wills, administering estates (including liquidating assets, making distributions, and preparing and filing state and federal estate tax returns), asserting creditor claims against estates, petitioning the court for resignations of fiduciaries, and drafting related estate planning documents.
Mr. Finkelstein regularly counsels health care clients, including not-for-profit trade associations, on various corporate governance matters and risk-avoidance strategies.
